This Privacy Policy describes how your personal information is collected, used, and shared when you visit, interact with, or make a purchase from talesfromafork.com (the “Site”). You must be at least eighteen (18) years to use the Site.

USE OF INFORMATION

When you subscribe to receive our email newsletter or other communications sent through the Site, we use your email address and name to add you to our list of subscribers and send you email newsletters or other communications. When you contact us through the Site, we use information you submit to us to respond to your questions or requests to us, fulfill your request, and to perform customer service. When you purchase products through the Site, we use your first name, last name, email address, postal address, phone number, and debit/credit card number or other billing information to process, fulfill, and ship your order. When you share blog posts or reply/comment on a blog post on the Site, we post your name and comment on the Site to verify or maintain the quality or safety of our Site. Users of the Site acknowledge and authorize us to contact them in accordance with the foregoing by telephone, notwithstanding the fact that such user may have opted into the Federal Trade Commission’s National Do Not Call or other similar registry.

In addition, Tales From A Fork reserves the right to share your personal information in all of the above categories with our counsel and accountants. Tales From A Fork also reserves the right to share your personal information in all of the above categories with any government or law enforcement agency that we deem necessary to comply with any applicable law or at the request of any government or law enforcement agency.
We may also transfer your personal information in all of the above categories to a successor entity in connection with a corporate merger, consolidation, sale of assets, bankruptcy, or other corporate change.
By utilizing the Site and/or online services, user hereby releases Tales From A Fork from any claims, damages, losses and liabilities resulting from or arising out of Tales From A Fork’ disclosure of any such user’s information to any third party.
Tales From A Fork will not share, transfer, or the information we collect from users or receive from our customers or other third parties regarding users other than as stated in this Privacy Policy, except in accordance with the directions of those customers and other third parties.
ACCESS AND MODIFICATION OF INFORMATION
To the extent required by applicable law, user may request that Tales From A Fork inform user about the personal information maintained by us with respect to user, and where appropriate, request that Tales From A Fork update, correct and/or suppress personal information about user that we maintain. Tales From A Fork will make all required updates and changes within the time specified by applicable law. User is permitted to remove user’s personal contact information from Tales From A Fork’s marketing list by utilizing the “unsubscribe” link located at the bottom of every email sent to users by Tales From A Fork or by directing any other request, in writing, to: Tales From A Fork, attn: president, 1970 28th Street, Springfield, OR 97477. To protect user’s confidentiality, Tales From A Fork will only respond to the physical or email address provided to Tales From A Fork in user’s request.
Information from Minors
The Site is not directed to children under 13 years of age. We do not knowingly solicit, collect, or use any personal information from children.
Anti-Spam Policy
Tales From A Fork seeks to ensure that it and third parties with whom it provides information relative to users comply with all applicable law relative to contact with users. In this regard, Tales From A Fork will only contact users for the following purposes: to acknowledge Tales From A Fork’s receipt of a user’s subscription request, online order or similar transaction, or to request additional information or action from user relative to any such transaction; in response to a user inquiry regarding the status of any transaction, or other communication; periodic contact expressing our appreciation for user’s business or patronage; and communicating with user for those reasons described in this Privacy Policy. In addition, Tales From A Fork has instituted the following protocols relative to electronic mail correspondence in order to facilitate Tales From A Fork’s compliance with applicable law such as the Can-Spam Act, including among other things: all emails sent to users by Tales From A Fork will conspicuously identify Tales From A Fork as the sender; the subject of emails will accurately describe the subject matter of the contents thereof, including clearly and conspicuously stating that the e-mail message is an advertisement if applicable; email messages will contain an “unsubscribe” link located at the bottom thereof, which will allow the user to opt out of getting email from Tales From A Fork in the future; and a current physical mailing address will be contained in all email communications, where the user can send suggestions, complaints or other correspondence.
Information Security
Tales From A Fork implements security measures to protect against unauthorized access to or unauthorized alteration, disclosure, or destruction of user’s information. Tales From A Fork restricts access to personal information to the third parties described above, who may need such information in order to operate, develop or improve online services. Persons receiving such information are bound by confidentiality obligations and may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations.
Your California Privacy Rights
Under the California Consumer Privacy Act of 2018 (“CCPA”), up to twice in a twelve (12) month period, California residents have the right to request that a business disclose what personal information (that identifies, relates to, describes, is capable of being associated with or could reasonably be linked, directly or indirectly, with a particular consumer or household) it collects, uses, discloses, and sells. This Privacy Policy contains important information regarding our collection, disclosure, and sale of personal information, in addition to instructions on how to exercise your rights regarding your personal information.
The personal information which we collect is noted above under the “Personal Information We Collect” and “Use of Information” headings. What Personal Information Do We Sell?
Under the definitions of “Sell” and “Sale” in the CCPA, we do not sell your personal information. We do not have any actual knowledge of the sale of, personal information of minors under 16 years of age. There are no financial incentives to disclose.
Your Right to Request to Know and How to Submit a Verified Request to Know

The information you provide will be used to verify your request and to attempt to identify you within our data records. If you elect to use an authorized agent to exercise your right to submit a request for information, we may require the following before processing the request: 1) proof of your written and signed permission with the authorized agent to act on your behalf; 2) direct verification of your identity to us; and 3) direct confirmation to us that you provided the authorized agent permission to submit the request on your behalf. The information which you submit in conjunction with your request to know will be used for the express purposes of verification and providing you with responsive information to your request, if required.
Your Right to Request Deletion and How to Submit a Verified Request to Delete
You have the right to request the deletion of any personal information which we have collected about you, or which we maintain.

If you elect to use an authorized agent to exercise your right to submit a request for deletion, we may require the following before processing the request: 1) proof of your written and signed permission with the authorized agent to act on your behalf; 2) direct verification of your identity to us; and 3) direct confirmation to us that you provided the authorized agent permission to submit the request on your behalf. The information which you submit in conjunction with your request to delete will be used for the express purposes of verification and fulfilling your request to delete, if required.
We utilize a two-step process for online requests to delete, whereby you clearly submit your request to delete, and second, you separately confirm that you want your personal information deleted.
To the extent that your personal information is necessary for us to maintain for a reason delineated in Cal. Civ. Code § 1798.105(d), including but not limited to complete a transaction for which the personal information was collected, provide a good or service you have requested, detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, debug, etc., or to comply with a legal obligation, we are not required to comply with your request for deletion. For instance, we are not required to delete personal information which is necessary to maintain suppression files for those individuals who have opted out of receiving email marketing from us. If we are unable to verify your request, we will notify you as well.
Your Rights to Non-Discrimination for the Exercise of Your Privacy Rights
California affords consumers with the right not to receive discriminatory treatment by a business for the exercise of their privacy rights conferred by the CCPA. This means that you cannot be denied goods or services; be charged different prices or rates; be provided with a different level or quality of goods or services; or have it suggested that you will receive a different price or rate or different level or quality of goods or services. Notwithstanding the above, a business can charge a consumer a different rate or price, or provide a different level or quality of goods or services, if that difference is reasonably related to the value provided to the consumer by the consumer’s data. Further, notwithstanding the above, a business may offer financial incentives for the collection of personal information, the sale of personal information, or the deletion of personal information, and may also offer a different price, rate, level, or quality of goods or services to the consumer if that different is directly related to the value provided to the consumer by the consumer’s data.
Amendment
We reserve the right to amend our Privacy Policy at our sole discretion and at any time. You should review the Privacy Policy periodically to check for amendments. We will post notice of modifications and additions to these terms on this page. Changes will not apply retroactively and will become effective immediately after they are posted. However, changes addressing new functions for an online service or changes made for legal reasons will be effective immediately.
